By purchasing and/or utilizing any of our Programs, Products, Services, or Program Materials, you acknowledge and consent the use of arbitration on an individual basis to resolve disputes, rather than resorting to jury trials. Additionally, you acknowledge that specific legal rights are waived, and you are entering into this agreement voluntarily, which limits the remedies available to you in the event of a dispute.

Usage and Agreement

When you purchase or use any of our Programs, Products, or Services, you agree to follow these Terms of Use, as well as our Disclaimer and Privacy Policy. Additionally, any other pertinent terms and conditions that may be applicable must be followed, and your actions are expected to align with these terms. Reproduction is only allowed as outlined in the copyright notice in these Terms of Use.

When you access or purchase any of our Program Materials through our Programs, Products, or Services, you become a Licensee. You are authorized to utilize our Programs, Products, Services, and Program Materials as outlined below:

You have the authorization to download and/or print complimentary materials from our website or email communications, including e-newsletters or any publicly shared content that does NOT belong to any paid Program, Product, or Service. This permission is solely for your personal or business use, with the condition that you provide proper credit by referencing our name, retaining all copyright and proprietary notices, and, if used electronically, incorporating a link back to the respective Website page(s) from which the information was sourced.

You are also allowed to download and/or print Program Materials for your personal use.

However, you are prohibited from sharing, selling, reprinting, or republishing any other Program Materials, including handouts, for the purpose of resale or mass reproduction within your own business. This applies to sharing with friends, family, colleagues, etc. If others wish to access these materials, they must individually acquire their own licenses.

Communication Guidelines

If you need assistance with your Programs, Products, Services, or Program Materials, please feel free to email us at [email protected]. We'll make every effort to promptly address your questions or concerns.

Payment and Online Transactions:

By selecting PayPal, debit card, or credit card as your payment method, you grant us the authority to automatically charge the chosen payment method for the Program, Product, or Service without needing further authorization. A digital receipt will be sent to you as confirmation of the transaction. If you receive a PayPal invoice or a Dubsado invoice, please make a manual payment by the due date stated on the invoice. Failure to do so will result in a hold on your chosen Program, Product, or Service until payment is received.

Not fulfilling an installment payment for any of the Programs, Products, or Services could lead to an instant suspension or termination of all such offerings. This would result in the loss of access to your account and any associated Programs, Products, or Services.

Should you either miss a payment within the stipulated time frame as per these Terms of Use, or choose to withdraw from our Programs, Products, or Services – regardless of the reason – you will continue to hold complete responsibility for the total cost of the Programs, Products, and/or Services.

Any data obtained during your purchase or transaction for our Programs, Products, and Services, including details like your name, address, payment method, credit card number, and billing information, may be gathered by both us and our payment processing partner. We advise you to review our Privacy Policy and also take a moment to go through the privacy policy of our payment processor.

You consent to buying products or services solely for either yourself or for someone else for whom you have the legal authority to make such purchases or have received explicit permission to use their personal details, including their name, address, payment method, credit card number, and billing information.

You acknowledge your financial responsibility for all transactions conducted by you or a representative authorized by you. Additionally, you commit to utilizing our Programs, Products, Services, and associated materials exclusively for valid, non-commercial intentions, refraining from engaging in speculative, deceitful, fraudulent, or unlawful activities.

We cannot tolerate or approve of any form of chargeback threat or legitimate chargeback initiated by your credit card provider.

Due to the explicit Refund Policy outlined in our Terms of Use, which you have accepted before finalizing any purchase of our Programs, Products, or Services, should a chargeback be initiated for a transaction or if we encounter a chargeback threat in relation to your purchase, we retain the authority to notify all three major credit reporting agencies or other relevant entities. This action may involve the inclusion of details in a chargeback database or classification as a delinquent account, potentially influencing your credit score adversely. The information shared will include your name, email address, order date, order amount, and billing address. Individuals seeking removal from the database due to chargeback misuse must settle the chargeback amount to facilitate the process.

Furthermore, we retain the privilege to engage a collections agency to recover outstanding payments not received by or on the designated due date. Additionally, we maintain the option to inform all three major credit reporting agencies about your unpaid amount, either directly or in cooperation with a collections agency.

In the event of making a purchase from one of our affiliates or any other individual or company through a link provided on or via our Programs, Products, or Services ("Merchant"), it's important to note that any information gathered during the transaction, including your credit card details and contact particulars, may also be collected by the merchant and their payment processing entity. Your interactions, communications, or business transactions with any affiliate, individual, or company on or via our Programs, Products, or Services, as well as all aspects of your purchase such as payment terms, refund policies, and delivery obligations, are exclusively between you and the Merchant. You acknowledge that we bear no responsibility or liability for any losses, damages, refunds, or any other issues arising from such interactions with a Merchant.

Payment processing companies and Merchants might adhere to distinct privacy and data collection procedures compared to ours. We hold no accountability or legal obligation for the separate policies maintained by these payment processing companies and Merchants. Moreover, when you initiate specific purchases via our Programs, Products, or Services, you could potentially be subjected to supplementary terms and conditions set forth by a payment processing company, Merchant, or our own that are directly relevant to your transaction. To access further insights into a Merchant's terms and conditions that could be applicable, you can refer to the merchant's website and explore its information links or reach out to the Merchant directly.

By completing a purchase through our Website or utilizing its Content, you hereby exempt us, our affiliates, our payment processing company, and Merchants from any liability for damages you may experience. Additionally, you pledge not to bring forward any claims against us or any of the aforementioned parties stemming from your transaction or engagement with our Website or its Content.

Refund Policy:

We offer a 3-day Money Back Guarantee for the True U College Admission. You have the option to request a full refund at any time between your Program purchase date and 3 days after the Program content becomes accessible to you (“Refund Period”) by (1) sending an email to [email protected] to initiate your refund request, and (2) providing your name and email address.

If your refund request falls outside the initial 3-day period but is within 14 days from the time the Program content became accessible to you ("Second Refund Period"), you can request a refund by (1) sending an email to [email protected], (2) providing your name and email address, and (3) submitting ALL of the following:

  • Screenshots of Completion of the YouScience Interests and Strengths Assessment.
  • Please explain why True U College Admissions didn't meet your expectations and what specific aspects you were hoping to gain from the course but didn't find.

Company Discretion. Following the submission of your materials, the decision to grant or deny the refund request rests solely at the discretion of the Company.

It's important to understand that refund requests may not be initiated once the Refund Period has concluded. Your refund will be issued using the same payment method as your initial purchase, unless we provide you with different instructions. Kindly allow a processing time of 7 days after submitting your request for the refund to be processed.

For refunds requested beyond the Second Refund Period for Programs, Products, and Services. It's important to note that due to the substantial time, effort, preparation, and meticulousness invested in the creation and provision of our Programs, Products, Services, and Program Materials, we maintain a policy of no refunds. Except where required by applicable law, you acknowledge that we do not facilitate refunds for any portion of your payment associated with our Programs, Products, and Services, and under no circumstances will refunds be granted. Your utilization and/or acquisition of any of our Programs, Products, Services, or Program Materials signifies your understanding and agreement that all sales are considered final, and no refunds will be issued beyond the second refund period.

Termination

You have the authority to discontinue your engagement with or involvement in our Programs, Products, or Services at any point by sending an email to [email protected].

We retain the exclusive right, at our discretion, to decline or suspend your access to our Programs, Products, Services, or Program Materials, either entirely or partially, without prior notice. This action may be communicated to you via email using the address you provided during the purchase of the Program, Product, or Service.

In the event of cancellation or termination initiated by either party, a 24-hour window will be granted for settling any outstanding payments or balances owed to us.

Upon termination initiated by either party, we retain the authority to promptly deny or terminate your access to any facet of our Programs, Products, Services, and/or Program Materials. This includes, but is not limited to, our Website, private forum, email correspondences, Facebook groups, live webinars, conference calls, or any other communication channels associated with our Programs, Products, Services, or Program Materials. This action may be executed without prior notification and rests solely within our discretion.

All provisions outlined within this Terms of Use, includes, but not limited to, copyright, trademark, and intellectual property rights, disclaimers, liability limitations, claim releases, and our Refund Policy, shall remain in effect both now and in the future, persisting even subsequent to termination, whether initiated by you or us.

Dispute Resolution

While it is hoped that any potential disagreements can be resolved through mail communication, in the event that we are unable to achieve a resolution within a reasonable timeframe, you hereby consent that the exclusive method for resolving legal disputes shall be through binding arbitration. This arbitration will be conducted before a single arbitrator, chosen mutually, in accordance with the regulations set forth by the American Arbitration Association Rules. Before initiating arbitration proceedings, you are required to send an email to us at [email protected], outlining the reasons for your dissatisfaction with the Program. It is understood and agreed upon that the sole remedy available to you through arbitration is a complete refund of the payment you have made thus far. No other actions, financial awards, consequential damages, or any other forms of compensation may be awarded to you. Both parties mutually acknowledge that the arbitrator's decision will be definitive and binding, and may be recognized as a legal judgment in any court possessing the appropriate jurisdiction.

Upon purchasing our Programs, Products, or Services, you are expressly consenting to a modification of the statute of limitations, stipulating that the initiation of arbitration proceedings must occur within one (1) year from the date of your aforementioned email to us. Failing to comply with this timeframe will result in the forfeiture of your ability to pursue dispute resolution through arbitration or to undertake any other legal actions.

Furthermore, you agree that any arbitration proceedings will be conducted within Travis County in the State of Texas, where our business is situated. The prevailing party shall be entitled to reasonable attorneys' fees and all essential costs necessary for enforcing the arbitrator's decision.

In the event of a dispute between us, you pledge not to partake in any conduct or communications, whether public or private, including on social media platforms, aimed at disparaging us, our Company, or any of our Programs, Products, or Services. However, it is understood that, as required by law or during arbitration proceedings, you retain the right to express your opinions and thoughts as part of the legal process.

Should any provisions within these Terms of Use be deemed invalid or unenforceable for any reason, such determination shall not impact the validity or enforceability of any other terms, which shall remain in full force and effect.

Governing Law

The regulations of the State of Texas, where our business is registered, shall serve as the governing laws for these Terms of Use, disregarding any conflict of laws principles.
